Agreement to terms

These Terms and Conditions (“Terms”) govern your access to and use of Quizava’s websites, applications, and related services (collectively, the “Services”), operated by Quizava (“Quizava”, “we”, “us”, or “our”). By creating an account, accessing the Services, or clicking to accept these Terms where that option is made available, you agree to be bound by these Terms. If you do not agree, do not use the Services.

If you use the Services on behalf of an organization, you represent that you have authority to bind that organization and “you” includes that entity.

Services and accounts

Quizava provides tools to create, deliver, and administer quizzes, exams, assessments, and related educational content. Features may vary by plan. We may modify, suspend, or discontinue parts of the Services with reasonable notice where practicable, or immediately where necessary for security, legal compliance, or urgent operational reasons.

You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly at [email protected] if you suspect unauthorized access.

Acceptable use

You agree not to:

• Violate applicable law or infringe others’ rights.
• Upload or distribute malware, attempt to breach or stress our systems, or interfere with other users’ use of the Services.
• Scrape, harvest, or automate access to the Services except as allowed by our documented APIs or with our prior written consent.
• Use the Services to generate or distribute content that is unlawful, harassing, hateful, or sexually exploitative of minors.
• Misrepresent your identity or affiliation, or attempt to access data you are not authorized to view.

We may investigate violations and suspend or terminate accounts or access as described below.

Your content and license

You retain ownership of content you submit to the Services (“Your Content”). You grant Quizava a worldwide, non-exclusive license to host, reproduce, process, transmit, display, and create technical derivatives (such as resized media or transcripts) solely to operate, improve, secure, and support the Services for you, consistent with our Privacy Policy.

You represent that you have the rights necessary to grant this license for Your Content.

Fees, subscriptions, and taxes

Paid plans are billed according to the prices and renewal terms presented at checkout or in your order. Taxes may apply based on your location. Unless stated otherwise, subscriptions renew automatically until cancelled. Cancellation takes effect at the end of the then-current billing period.

Artificial intelligence features

Where the Services offer AI-assisted features (for example, question generation), outputs may be inaccurate or incomplete. You are responsible for reviewing and approving content before use in high-stakes or regulated contexts. Do not input sensitive personal data or confidential third-party material into prompts unless our documentation and agreements expressly permit it.

Proctoring and monitoring

Some assessments may collect device signals, webcam snapshots, metadata, or other signals described in-product and in our Privacy Policy. Administrators using these features must comply with applicable laws and institutional policies and provide appropriate notices to participants.

Disclaimers

Except where prohibited by law, the Services are provided “as is” and “as available.” To the fullest extent permitted, Quizava disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, Quizava and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, goodwill, or business opportunities, arising from or related to the Services or these Terms.

Quizava’s aggregate liability for claims arising out of or related to the Services or these Terms shall not exceed the greater of (a) the amounts you paid to Quizava for the Services in the twelve (12) months before the claim, or (b) one hundred US dollars ($100). Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.

Indemnity

You will defend, indemnify, and hold harmless Quizava and its directors, officers, employees, and contractors from claims, damages, liabilities, costs, and fees (including reasonable attorneys’ fees) arising from Your Content or your violation of these Terms or applicable law.

Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access for breach of these Terms, risk to the Services or third parties, or non-payment after notice where appropriate. Provisions intended to survive (including confidentiality, disclaimers, limitations, indemnity, and governing law) survive termination.

Governing law and disputes

These Terms are governed by the laws of the jurisdiction specified in your order or, if none is specified, the laws applicable to Quizava’s place of incorporation, excluding conflict-of-law rules. Courts in that jurisdiction have exclusive jurisdiction unless mandatory consumer-protection rules in your country require otherwise.

Changes

We may update these Terms from time to time. We will post the revised Terms on this page and update the effective date below. Continued use after the effective date constitutes acceptance unless otherwise required by law.
